Chapter 18

א דָבָר יָדוּעַ וּבָרוּר שֶׁאִם יוֹצִיא לְךָ הַחֶשְׁבּוֹן שֶׁהַיָּרֵחַ יֵרָאֶה בַּלַּיִלָה. אֶפְשָׁר שֶׁיֵּרָאֶה וְאֶפְשָׁר שֶׁלֹּא יֵרָאֶה מִפְּנֵי הֶעָבִים שֶׁמְּכַסִּין אוֹתוֹ אוֹ מִפְּנֵי הַמָּקוֹם שֶׁהוּא גַּיְא אוֹ שֶׁיִּהְיֶה הַר גָּבוֹהַּ כְּנֶגֶד רוּחַ מַעֲרָב לְאַנְשֵׁי אוֹתוֹ הַמָּקוֹם שֶׁנִּמְצְאוּ כְּאִלּוּ הֵן יוֹשְׁבִין בַּגַּיְא. שֶׁהַיָּרֵחַ לֹא יֵרָאֶה לְמִי שֶׁהוּא בְּמָקוֹם נָמוּךְ אֲפִלּוּ הָיָה גָּדוֹל וְיֵרָאֶה לְמִי שֶׁהוּא עוֹמֵד בְּרֹאשׁ הַר גָּבוֹהַּ וְתָלוּל אַף עַל פִּי שֶׁהַיָּרֵחַ קָטָן בְּיוֹתֵר. וְכֵן יֵרָאֶה לְמִי שֶׁשּׁוֹכֵן עַל שְׂפַת הַיָּם אוֹ לְמִי שֶׁמְּהַלֵּךְ בִּסְפִינָה בַּיָּם הַגָּדוֹל אַף עַל פִּי שֶׁהוּא קָטָן בְּיוֹתֵר:

1 It is well-known and clear that if the calculation [demonstrated] that the moon will be seen at night, it is [only] possible that it will be seen. But it is [also] possible that it will not be seen because of the clouds covering it or because of the place which is a valley or that there is a tall mountain blocking the western direction from the people of that place, such that it is as if they are residing in a valley. For the moon is not visible to someone in a low place even if it is big, but it is seen to someone standing on the top of a tall and steep mountain even when the moon is very small. And likewise is it visible to one dwelling by the seashore or to one traveling on a boat in the Great (Mediterranean) Sea, even though it is very small.

ב וְכֵן בִּימוֹת הַגְּשָׁמִים אִם יִהְיֶה יוֹם צַח יֵרָאֶה הַיָּרֵחַ יוֹתֵר מִמַּה שֶּׁיֵּרָאֶה בִּימוֹת הַחַמָּה. לְפִי שֶׁבִּימוֹת הַגְּשָׁמִים אִם יִהְיֶה יוֹם צַח יִהְיֶה הָאֲוִיר זַךְ הַרְבֵּה וְיֵרָאֶה הָרָקִיעַ בְּטֹהַר יוֹתֵר מִפְּנֵי שֶׁאֵין שָׁם אָבָק שֶׁיִּתְעָרֵב בָּאֲוִיר. אֲבָל בִּימוֹת הַחַמָּה יִהְיֶה הָאֲוִיר כְּאִלּוּ הוּא מְעֵשָּׁן מִפְּנֵי הָאָבָק וְיֵרָאֶה הַיָּרֵחַ קָטָן:

2 And likewise if it is a clear day in the winter, the moon will be more visible than it would be in the summer. [This is] because if it would be a clear day in the winter, the air would very pure and the sky would be seen with greater transparency; as there is no dust there to mix into the sky. But in the summer the air is as if it is smoky because of the dust, so the moon looks small.

ג וְכָל זְמַן שֶׁתִּמָּצֵא קֶשֶׁת הָרְאִיָּה וְהָאֹרֶךְ הָרִאשׁוֹן שֶׁתַּעֲרֹךְ לָהּ עִם שְׁנֵי הַקִּצִּין שֶׁלָּהֶם בְּצִמְצוּם. יִהְיֶה הַיָּרֵחַ קָטָן בְּיוֹתֵר וְלֹא יֵרָאֶה אֶלָּא בְּמָקוֹם גָּבוֹהַּ בְּיוֹתֵר. וְאִם תִּמָּצֵא קֶשֶׁת הָרְאִיָּה וְהָאֹרֶךְ הָרִאשׁוֹן אֲרֻכִּין הַרְבֵּה וְהוֹסִיפוּ עַד סוֹף הַקִּצִּים שֶׁלָּהֶן מִמַּעֲלוֹת. יֵרָאֶה הַיָּרֵחַ גָּדוֹל וּלְפִי אֹרֶךְ הַקֶּשֶׁת וְהָאֹרֶךְ הָרִאשׁוֹן יִהְיֶה גָּדְלוֹ וּגְלִיָּתוֹ לַכּל:

3 And anytime you find the arc of the sighting and the first length that you measure with it [to establish] the two edges to be narrow, the moon will be very small and it will only be visible in a very high place. But if you find the arc of the sighting and the first length to be very large and they have more degrees to the end of their edges, the moon will look large. So the size and visibility will be according to the largeness of the arc and the first length.

ד לְפִיכָךְ רָאוּי לְבֵית דִּין לָשׂוּם שְׁנֵי דְּבָרִים אֵלּוּ בְּלִבָּם. שֶׁהֵן זְמַן הָרְאִיָּה וּמְקוֹמָהּ. וְשׁוֹאֲלִין אֶת הָעֵדִים בְּאֵי זֶה מָקוֹם רְאִיתֶם. שֶׁאִם הָיְתָה קֶשֶׁת הָרְאִיָּה קְצָרָה וְיִתֵּן הַחֶשְׁבּוֹן שֶׁיֵּרָאֶה בְּצִמְצוּם. כְּגוֹן שֶׁהָיְתָה קֶשֶׁת הָרְאִיָּה ט' מַעֲלוֹת וְה' חֲלָקִים וְהָיָה הָאֹרֶךְ הָרִאשׁוֹן י"ג מַעֲלוֹת בְּשָׁוֶה וּבָאוּ עֵדִים שֶׁרָאוּהוּ. אִם הָיָה בִּימוֹת הַחַמָּה אוֹ שֶׁהָיוּ בְּמָקוֹם נָמוּךְ חוֹשְׁשִׁין לָהֶן וּבוֹדְקִין אוֹתָן הַרְבֵּה וְאִם הָיָה בִּימוֹת הַגְּשָׁמִים אוֹ בְּמָקוֹם גָּבוֹהַּ בְּיוֹתֵר וַדַּאי יֵרָאֶה אִם לֹא יִהְיוּ שָׁם עָבִים הַמַּבְדִּילִין:

4 Hence it is fitting for the court to [pay attention] to these two things, which are the time of the sighting and its place. And they ask the witnesses, "In which place did you see [it]?" As if the arc of sighting was small and the calculation [demonstrates] that it will be seen narrowly – such as if the arc of the sighting was thirteen degrees and five parts, and the first length was exactly thirteen degrees – and witnesses came that saw it: If it was in the summer or they were in a low place, we suspect them and examine them much. But if it was in the winter or in a very high place, it was certainly seen unless there were clouds there intervening.

ה עֵדִים שֶׁרָאוּ אֶת הַחֹדֶשׁ בִּזְמַנּוֹ וּבָאוּ וְהֵעִידוּ וְקִבְּלוּם בֵּית דִּין וְקִדְּשׁוּ אֶת הַחֹדֶשׁ הַזֶּה הָרִאשׁוֹן וּמָנוּ כ"ט יוֹם מִן הַיּוֹם הַמְ[קֵ]דָּשׁ. וְלֵיל שְׁלֹשִׁים לֹא נִרְאָה הַיָּרֵחַ מִפְּנֵי שֶׁאִי אֶפְשָׁר לוֹ לְהֵרָאוֹת אוֹ מִפְּנֵי שֶׁכִּסּוּהוּ עָבִים. וַהֲרֵי בֵּית דִּין מְצַפִּין לוֹ כָּל יוֹם שְׁלֹשִׁים כְּמוֹ שֶׁבֵּאַרְנוּ. וְלֹא בָּאוּ עֵדִים וְעִבְּרוּ אֶת הַחֹדֶשׁ וְנִמְצָא יוֹם ר"ח הַשֵּׁנִי יוֹם ל"א כְּמוֹ שֶׁבֵּאַרְנוּ:

5 Witnesses that saw the [new] moon in its time and came and testified, and the court accepted them and sanctified this first month; and [then the court] counted twenty-nine days from the sanctified day and the moon was not visible on the thirtieth day, because it was impossible to see it, or it was covered with clouds – and surely the court anticipates it the whole thirtieth day, as we have explained – and witnesses do not come that the moon be ratified, it comes out that the second Rosh Chodesh (first day of the month) is the thirty-first day, as we have explained.

ו וְהִתְחִילוּ לִמְנוֹת כ"ט יוֹם מִן יוֹם רֹאשׁ הַחֹדֶשׁ הַשֵּׁנִי וְלֵיל שְׁלֹשִׁים לֹא נִרְאָה הַיָּרֵחַ. אִם תֹּאמַר שֶׁכָּךְ מְעַבְּרִין אֶת זֶה וְעוֹשִׂין אוֹתוֹ שְׁלֹשִׁים וְקוֹבְעִין רֹאשׁ הַחֹדֶשׁ הַשְּׁלִישִׁי יוֹם ל"א. כָּךְ אֶפְשָׁר שֶׁלֹּא יֵרָאֶה הַיָּרֵחַ בְּלֵיל שְׁלֹשִׁים גַּם מֵחֹדֶשׁ זֶה וְנִמְצְאוּ מְעַבְּרִין וְהוֹלְכִין וְעוֹשִׂין חֳדָשִׁים אַחַר שְׁלֹשִׁים כָּל הַשָּׁנָה כֻּלָּהּ. וְנִמְצָא בְּחֹדֶשׁ אַחֲרוֹן אֶפְשָׁר שֶׁיֵּרָאֶה הַיָּרֵחַ בְּלֵיל כ"ה בּוֹ אוֹ בְּלֵיל כ"ו. וְאֵין לְךָ דְּבַר שְׂחוֹק וְהֶפְסֵד יוֹתֵר מִזֶּה:

6 And they began to count twenty-nine days from the second Rosh Chodesh and the moon is not seen on the Night of the Thirtieth: If you say that we ratify it this way and make [that month] thirty and set the third Rosh Chodesh [on] the thirty-first day, it is thus possible that the moon will not be seen on the thirtieth night of this month as well, and they will come out continuing to ratify the months after the Thirtieth the whole entire year! And it comes out that in the last month, it is possible that the moon be seen on the Night of the Twenty-fifth or the the Night of the Twenty-sixth. And there is no more laughable and injurious matter than this.

ז וְאַל תֹּאמַר שֶׁהַדָּבָר הַזֶּה דָּבָר שֶׁאֵינוֹ מָצוּי הוּא שֶׁלֹּא יֵרָאֶה הַיָּרֵחַ בְּכָל הַשָּׁנָה. אֶלָּא דָּבָר קָרוֹב הוּא הַרְבֵּה. וּפְעָמִים רַבּוֹת יֶאֱרַע זֶה וְכַיּוֹצֵא בּוֹ בַּמְּדִינוֹת שֶׁזְּמַן הַגְּשָׁמִים שָׁם אָרֹךְ וְהֶעָבִים רַבִּים. שֶׁאֵין אָנוּ אוֹמְרִין שֶׁלֹּא יֵרָאֶה הַיָּרֵחַ בְּכָל הַשָּׁנָה אֶלָּא שֶׁלֹּא יֵרָאֶה בִּתְחִלַּת הֶחֳדָשִׁים וְיֵרָאֶה אַחַר כָּךְ. וּפְעָמִים לֹא יֵרָאֶה מִפְּנֵי שֶׁאִי אֶפְשָׁר לוֹ שֶׁיֵּרָאֶה בָּהֶם וְחֳדָשִׁים שֶׁאֶפְשָׁר שֶׁיֵּרָאֶה בָּהֶם לֹא יֵרָאֶה מִפְּנֵי הֶעָבִים אוֹ מִפְּנֵי שֶׁהָיָה קָטָן בְּיוֹתֵר וְלֹא נִתְכַּוֵּן אָדָם לִרְאוֹתוֹ:

7 And do not say that this thing is not common, that the moon not be visible the whole year. Rather it is something very likely. As many times this, or that which is similar to it, happens in the provinces in which their winters are long and the clouds many. For we are not saying that the moon is not seen the whole year, but rather that it is not seen at the beginning of the month, but it is seen afterwards. And sometimes it is not seen because it is impossible to see it on [those times], and on the months that it is possible for one to see them, he does not see [it] because of the clouds or because it was very small and he did not focus on it.

ח אֶלָּא הַקַּבָּלָה שֶׁהָיָה בְּיַד חֲכָמִים אִישׁ מִפִּי אִישׁ מִפִּי משֶׁה רַבֵּנוּ כָּךְ הִיא. שֶׁבִּזְמַן שֶׁלֹּא יֵרָאֶה הַיָּרֵחַ בִּתְחִלַּת הֶחֳדָשִׁים חֹדֶשׁ אַחַר חֹדֶשׁ. בֵּית דִּין קוֹבְעִין חֹדֶשׁ מְעֵבָּר מִשְּׁלֹשִׁים יוֹם וְחֹדֶשׁ חָסֵר מִכ"ט יוֹם. וְכֵן מְחַשְּׁבִין וְקוֹבְעִין חֹדֶשׁ מְעֻבָּר וְחֹדֶשׁ חָסֵר בִּקְבִיעָה לֹא בְּקִדּוּשׁ. שֶׁאֵין מְקַדְּשִׁין אֶלָּא עַל הָרְאִיָּה. וּפְעָמִים עוֹשִׂין מָלֵא אַחַר מָלֵא אוֹ חָסֵר אַחַר חָסֵר כְּמוֹ שֶׁיֵּרָאֶה לָהֶם מִן הַחֶשְׁבּוֹן:

8 Rather the tradition that was in the hand of the Sages – one man from the mouth of another, from the mouth of Moshe, our teacher – is thus: That at a time when the moon is not seen at the beginning of [several] months – one month after the other – the court sets a [full] month of thirty days and a lacking month of twenty-nine day. And so they calculate and set the [full] month and the lacking month by setting – not by sanctification. For we only sanctify based on sighting. And sometimes they make a full [month] after a full [month], and sometimes a lacking [month] after a lacking [month], as it appears to them from the calculation.

ט וּמִתְכַּוְּנִין לְעוֹלָם בְּחֶשְׁבּוֹנָם שֶׁאִם יֵרָאֶה הַיָּרֵחַ בַּחֹדֶשׁ הַבָּא יֵרָאֶה בִּזְמַנּוֹ אוֹ בְּלֵיל עִבּוּרוֹ. לֹא שֶׁיֵּרָאֶה קֹדֶם זְמַנּוֹ שֶׁהוּא לֵיל כ"ח. וּבְחֶשְׁבּוֹנוֹת הָרְאִיָּה הָאֵלּוּ שֶׁבֵּאַרְנוּ יִתְבָּאֵר לְךָ וְתֵדַע מָתַי אֶפְשָׁר שֶׁיֵּרָאֶה, וּמָתַי אִי אֶפְשָׁר, שֶׁלֹּא יֵרָאֶה. וְעַל זֶה סוֹמְכִין וּמְעַבְּרִין חֹדֶשׁ אַחַר חֹדֶשׁ אוֹ עוֹשִׂין חֹדֶשׁ חָסֵר אַחַר חֹדֶשׁ חָסֵר. וּלְעוֹלָם אֵין פּוֹחֲתִין מֵאַרְבָּעָה חֳדָשִׁים הַמְעֻבָּרִין בְּשָׁנָה וְלֹא מוֹסִיפִין עַל שְׁמוֹנָה חֳדָשִׁים הַמְעֻבָּרִין. וְגַם לְעִבּוּר חֳדָשִׁים אֵלּוּ שֶׁמְּעַבְּרִין לְפִי חֶשְׁבּוֹן עוֹשִׂין סְעֻדַּת עִבּוּר הַחֹדֶשׁ כְּמוֹ שֶׁאָמַרְנוּ בְּפֶרֶק שְׁלִישִׁי:

9 And they always intend in their calculations that if the moon be sighted in the next month, it would be sighted in its time or on the night of the intercalation; not that it be seen before its time, which is the night of the twenty-eighth. And in these calculations of the sighting that we have explained it will be become elucidated to you and you will know when it is possible that it will be seen and when it is possible that it will not be seen. And upon this do we rely and intercalate one month after [another] or make one lacking month after [another]. But we never have less than four intercalated months in a year nor more than eight intercalated months. And also when we intercalate these months according to the calculation, we make the meal of intercalating the month, [that] we mentioned in the third chapter.

י וְכָל שֶׁתִּמְצָא בַּגְּמָרָא מִדְּבָרִיִם שֶּׁמַּרְאִין שֶׁבֵּית דִּין סוֹמְכִין עַל הַחֶשְׁבּוֹן וּמִפִּי משֶׁה מִסִּינַי שֶׁהַדָּבָר מָסוּר לָהֶם וְהָרְשׁוּת בְּיָדָם לְחַסֵּר אוֹ לְעַבֵּר. וְכֵן זֶה שֶׁחָסֵר תִּשְׁעָה חֳדָשִׁים בַּשָּׁנָה וְכָל כַּיּוֹצֵא בָּזֶה הַכּל עַל עִקָּר זֶה הוּא בָּנוּי בִּזְמַן שֶׁלֹּא נִרְאֶה הַחֹדֶשׁ בִּזְמַנּוֹ:

10 And all that you find in the Gemara of the things that show that the court relies on the calculation, or from the mouth of Moshe from Sinai that the thing is given over to them and authority is in their hand to make a lacking [month] or to intercalate – and likewise that which one made nine lacking months in a year, or anything that is similar to it – it is all built on this principle, at a time when the new moon is not seen at its time.

יא וְכֵן זֶה שֶׁאָמְרוּ חֲכָמִים שֶׁמְּעַבְּרִין אֶת הַחֹדֶשׁ לְצֹרֶךְ הוּא בֶּחֳדָשִׁים אֵלּוּ שֶׁמְּעַבְּרִין אוֹתָן לְפִי חֶשְׁבּוֹן וְעוֹשִׂין אֶחָד מָלֵא וְאֶחָד חָסֵר. וְיֵשׁ לָהֶם לְעַבֵּר חֹדֶשׁ אַחַר חֹדֶשׁ אוֹ לְחַסֵּר. בָּזֶה הוּא שֶׁמְּעַבְּרִין לְצֹרֶךְ מִפְּנֵי שֶׁלֹּא נִרְאֶה הַיָּרֵחַ בִּזְמַנּוֹ. אֶלָּא בְּעֵת שֶׁיֵּרָאֶה הַיָּרֵחַ בִּזְמַנּוֹ שֶׁהוּא תְּחִלַּת הֱיוֹתוֹ נִרְאֶה אַחַר שֶׁנִּתְקַבֵּץ עִם הַשֶּׁמֶשׁ מְקַדְּשִׁין לְעוֹלָם:

11 And likewise that which the Sages said that we intercalate the month for a purpose is with these months that we intercalate according to the calculation and make one full and one lacking. And they may [thus] intercalate one month after another or make [two consecutive months] lacking. It is in this that we intercalate for a purpose, as the moon was not seen in its time. But when the moon is seen in its time, which is the beginning of its being seen after it intersects the [orbit of the] sun, we always sanctify it.

יב וְכָל הַדְּבָרִים הָאֵלּוּ בִּזְמַן שֶׁיֵּשׁ שָׁם בֵּית דִּין וְסוֹמְכִין עַל הָרְאִיָּה. אֲבָל בִּזְמַנִּים אֵלּוּ אֵין סוֹמְכִין אֶלָּא עַל הַקְּבִיעָה בְּזֶה הַחֶשְׁבּוֹן הָאֶמְצָעִי הַפָּשׁוּט בְּכָל יִשְׂרָאֵל כְּמוֹ שֶׁבֵּאַרְנוּ בַּהֲלָכוֹת אֵלּוּ:

12 And all of these things are at a time when there is a court and we rely upon the sighting. But in these times, we only rely upon the fixing with this intermediate calculation which has spread among all of Israel, as we have explained in these laws.

יג יִתְבָּאֵר בְּסִפְרֵי הַחֶשְׁבּוֹן הַתְּקוּפוֹת וְהַגִּימַטְרִיָּאוֹת שֶׁאִם יֵרָאֶה הַיָּרֵחַ בְּאֶרֶץ יִשְׂרָאֵל יֵרָאֶה בְּכָל מְדִינוֹת הָעוֹלָם שֶׁהֵן לְמַעֲרַב אֶרֶץ יִשְׂרָאֵל וּמְכֻוָּנוֹת כְּנֶגְדָּהּ. וְאִם יִתֵּן הַחֶשְׁבּוֹן שֶׁלֹּא יֵרָאֶה בְּאֶרֶץ יִשְׂרָאֵל אֶפְשָׁר שֶׁיֵּרָאֶה בִּמְדִינוֹת אֲחֵרוֹת שֶׁהֵן לְמַעֲרַב אֶרֶץ יִשְׂרָאֵל וּמְכֻוָּנוֹת כְּנֶגְדָּהּ. לְפִיכָךְ אִם יֵרָאֶה הַיָּרֵחַ בִּמְדִינָה שֶׁהִיא לְמַעֲרַב אֶרֶץ יִשְׂרָאֵל אֵין בָּזֶה רְאָיָה שֶׁלֹּא יֵרָאֶה בְּאֶרֶץ יִשְׂרָאֵל אֶלָּא אֶפְשָׁר שֶׁנִּרְאֶה הַיָּרֵחַ בְּאֶרֶץ יִשְׂרָאֵל:

13 It is explained in the books of the seasons and geometry that if the moon is seen in the Land of Israel, it will be seen in all of the provinces of the world that are to the west of the Land of Israel across from it. But if the calculation comes out that it will not be seen in the Land of Israel, it is possible that it will be seen in [other] provinces that are to the west of the Land of Israel across from it. Hence if the moon would be seen in a province that is to the west of the Land of Israel, there is no proof in this that it will not be seen in the Land of Israel. Rather it is possible that the moon will be seen in the Land of Israel.

יד אֲבָל אִם לֹא יֵרָאֶה הַיָּרֵחַ בְּרֹאשׁ הֶהָרִים בַּמְּדִינָה הַמַּעֲרָבִית הַמְכֻוֶּנֶת כְּנֶגֶד אֶרֶץ יִשְׂרָאֵל בְּיָדוּעַ שֶׁלֹּא נִרְאֶה בְּאֶרֶץ יִשְׂרָאֵל:

14 But if the moon would not be seen at the top of the hills in the western province across from the Land of Israel, it is known that it was not visible in the Land of Israel.

טו וְכֵן אִם לֹא יֵרָאֶה הַיָּרֵחַ בְּאֶרֶץ יִשְׂרָאֵל בְּיָדוּעַ שֶׁלֹּא נִרְאֶה בְּכָל מְדִינוֹת הָעוֹלָם שֶׁהֵן לְמִזְרַח אֶרֶץ יִשְׂרָאֵל וּמְכֻוָּנוֹת כְּנֶגְדָּהּ. וְאִם יֵרָאֶה בְּאֶרֶץ יִשְׂרָאֵל אֶפְשָׁר שֶׁיֵּרָאֶה בִּמְדִינוֹת מִזְרָחִיּוֹת וְאֶפְשָׁר שֶׁלֹּא יֵרָאֶה. לְפִיכָךְ אִם יֵרָאֶה בִּמְדִינָה שֶׁהִיא לְמִזְרַח אֶרֶץ יִשְׂרָאֵל וּמְכֻוֶּנֶת כְּנֶגְדָּהּ בְּיָדוּעַ שֶׁנִּרְאֶה בְּאֶרֶץ יִשְׂרָאֵל. וְאִם לֹא נִרְאֶה בַּמְּדִינָה הַמִּזְרָחִית אֵין בָּזֶה רְאָיָה אֶלָּא אֶפְשָׁר שֶׁיֵּרָאֶה בְּאֶרֶץ יִשְׂרָאֵל:

15 And likewise, if the moon will not be seen in the Land of Israel, it is known that it not visible in all of the provinces of the world that are to the east of the Land of Israel across from it. But if it will be seen in the Land of Israel, it is possible that it will be seen in the eastern provinces, but it is [also] possible that it will not be seen. Hence if it will be seen in a province that is east of the Land of Israel and across from it, it is known that it is visible in the Land of Israel. But if it is not visible in the eastern provinces, there is no proof in this. Rather it is possible that it will be seen in the Land of Israel.

טז וְכָל אֵלּוּ הַדְּבָרִים כְּשֶׁהָיוּ הַמְּדִינוֹת שֶׁבַּמַּעֲרָב וְשֶׁבַּמִּזְרָח מְכֻוָּנוֹת. כְּגוֹן שֶׁהָיוּ נוֹטוֹת לִצְפוֹן הָעוֹלָם מִשְּׁלֹשִׁים מַעֲלוֹת עַד ל"ה מַעֲלוֹת. אֲבָל אִם הָיוּ נוֹטוֹת לַצָּפוֹן יוֹתֵר מִזֶּה אוֹ פָּחוֹת. מִשְׁפָּטִים אֲחֵרִים יֵשׁ לָהֶן שֶׁהֲרֵי אֵינָן מְכֻוָּנוֹת כְּנֶגֶד אֶרֶץ יִשְׂרָאֵל. וּדְבָרִים אֵלּוּ שֶׁבֵּאַרְנוּ בְּעָרֵי מִזְרָח וּמַעֲרָב אֵינָן אֶלָּא לְהַגִּיד כָּל מִשְׁפְּטֵי הָרְאִיָּה לְהַגְדִּיל תּוֹרָה וּלְהַאְדִּירָהּ. לֹא שֶׁיִּהְיוּ בְּנֵי מִזְרָח אוֹ בְּנֵי מַעֲרָב סוֹמְכִין עַל רְאִיַּת הַיָּרֵחַ אוֹ תּוֹעִיל לָהֶם כְּלוּם. אֶלָּא לְעוֹלָם אֵין סוֹמְכִין אֶלָּא עַל קִדּוּשׁ בֵּית דִּין שֶׁבְּאֶרֶץ יִשְׂרָאֵל כְּמוֹ שֶׁבֵּאַרְנוּ כַּמָּה פְּעָמִים:

16 And all of these things are when the province in the west or in the east were across [from it], such that they extended to the north of the world (from its midpoint, meaning the equator) from thirty degrees to thirty-five degrees. But if they extended further or less than this to the north, they have different properties. For they are surely not across from the Land of Israel. And these things that we have explained about the cities of the East and the West are only to tell you the properties of sighting, 'to enlarge the Torah and to magnify it.' It is not that the residents of the East or the residents of the West rely upon the [local] sighting of the moon, or that it helps them at all. Rather we always only rely upon the sanctification of the court in the Land of Israel, as we have mentioned several times.
